Terms of Service

Welcome to Gardenful. These Terms of Service (“Terms”) govern your use of the Gardenful iOS application and related services (collectively, the “Service”) operated by Gardenful (“we,” “our,” or “us”). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

Eligibility

You must be at least 13 years old to use the Service, or the minimum age required by the law where you live if higher. If you are under the age of majority where you live, your parent or legal guardian must agree to these Terms on your behalf.

Your Account

Some features may be available without an account, while others may require one. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us promptly at support@gardenful.app if you suspect unauthorized access to your account.

Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations
• Attempt to interfere with or disrupt the Service or its infrastructure
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, scrapers) to access or interact with the Service
• Misrepresent your identity or impersonate any person or entity

AI-Generated Content

The Service may use artificial intelligence to generate visualizations, plant recommendations, and other outputs. You acknowledge and agree that:

• Outputs may be incomplete, inaccurate, or unsuitable for your needs and may not reflect actual site conditions, plant performance, or final results
• You are solely responsible for reviewing outputs and for any decisions or actions you take based on the Service
• The Service does not provide professional landscaping, horticultural, arborist, engineering, or safety advice
• We do not guarantee the accuracy, completeness, or suitability of any output

User Content

You may upload photos and provide preferences when using the Service (“User Content”). You retain ownership of your User Content. By uploading User Content, you grant Gardenful and the service providers we use to operate the Service a limited, non-exclusive permission to host, store, reproduce, transmit, process, display, and make technical modifications to your User Content as needed to provide and maintain the Service for you. This includes generating the garden visualization images you request, storing your uploads and generated images in your account, and keeping the Service functional and secure. This permission ends when your User Content is deleted from the Service, except that we may retain copies as needed for backups, security, fraud prevention, legal compliance, and routine system processes.

You represent that you own or have the necessary rights to any User Content you upload and that your User Content does not infringe on the rights of any third party.

Subscriptions & Payments

Gardenful may offer free, paid, or subscription-based features. If you purchase a subscription:

• Payment is processed through Apple's App Store. All purchases are subject to Apple's terms and conditions.
• Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
• You can manage or cancel your subscription at any time through your Apple ID account settings.
• Free trial periods, if offered, convert to a paid subscription at the end of the trial unless cancelled beforehand. Any unused portion of a free trial is forfeited upon purchasing a subscription.
• Refunds are handled by Apple in accordance with their refund policies.
• We may change or discontinue features or offerings at any time, subject to applicable law.

Intellectual Property

The Service and all related technology, software, models, designs, and content (excluding User Content) are owned by Gardenful or its licensors and protected by intellectual property laws. Except for the limited right to use the Service as permitted by these Terms, no rights are granted to you. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the Service without our prior written consent.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. Gardenful is a garden design tool and does not provide professional landscaping, agricultural, or botanical services. Any actions you take based on information from the Service are at your own risk.

Limitation of Liability

To the maximum extent permitted by applicable law, Gardenful shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us, if any, during the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Gardenful and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

Feedback

If you provide suggestions, ideas, or other feedback about the Service, we may use it without restriction or compensation to you.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service and delete your account at any time. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the “Last updated” date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in California.
